OFFICIAL CONTEST RULES

The Callaway 2024 Sweepstakes (the “Contest”) is intended to be conducted in Canada and shall be construed and evaluated according to applicable Canadian law. No purchase necessary. Participants must be of the age of majority in their province or territory of residence or older at the time of entry. Void in whole or part where prohibited by law. Entry in this Contest is subject to these Contest rules (the “Contest Rules”).

1. SPONSOR. The Contest is sponsored by Golf Town Limited, 7777 Weston Road, Suite 900, Woodbridge, Ontario, Canada, L4L 0G9 (“Golf Town” or the "Sponsor"). The Contest is subject to these Contest Rules and to all applicable federal and provincial laws.

2. ELIGIBILITY. The Contest is open only to residents of Canada who have reached the legal age of majority in their province or territory of residence or older at the time of entry. Employees of the Sponsor, its affiliates, subsidiaries, related companies, advertising and promotional agencies, and the immediate family members (i.e., parents, spouses, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of any of the above, are not eligible to participate in the Contest. The Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsors reserves the right, in its sole discretion; to disqualify any Entrant should such an Entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

3. CONTEST PERIOD. The Contest begins on Monday, June 3, 2024 at 12:00 a.m. Eastern Time (“ET”) and ends on Monday, July 1, 2024 at 11:59pm ET (the “Contest Period”) after which time the Contest will be closed and no further entries shall be accepted.

4. HOW TO ENTER. There is no purchase necessary to enter the Contest. Entrants can visit https://cloud.email.golftown.com/WomensOpenContest-CPKC-EN-2024 during the Contest Period, follow the on-screen instructions and complete all the required fields and click “submit”. At the time of completing the Entry Form, you will also have the opportunity to agree to receive email communications from Golf Town regarding its products, news and promotions. Opting-in to receive email communications from Golf Town will not in any way whatsoeverfit increase or otherwise impact the chances of winning in this Contest. After opting-in, you may withdraw this consent to receive such email communications without affecting your eligibility in this Contest. This section does not limit any other consent(s) that an individual may provide to the Sponsor or others in relation to the collection, use and/or disclosure of their personal information. Once you have fully completed the Entry Form with all required information, agreed to the Contest Rules, and followed the on-screen instructions to submit your completed Entry Form, you will automatically be eligible to receive one (1) entry (an “Entry”) in the Contest.

There is a limit of one (1) Entry per person. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Contest Rules; (ii) use multiple names, identities, e-mail addresses, and/or use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; and/or (iii) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she/they may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Sponsor, the prize sponsor, promotion agencies, suppliers, partners, representatives and agents, and their respective affiliates and their respective employees, directors, officers, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entry Forms, Entries and/or any other Contest-related information (collectively, “Contest-Related Information”), all of which are void.

In the event of a dispute regarding who submitted an Entry, the authorized holder of the email address used to participate in the Contest at the time of entry will be deemed to be the entrant. The authorized account holder is defined as the natural person who has created the email address account that can be verified by Sponsor. Each winner may be required to provide the Sponsor with proof that the winner is the authorized account holder that is associated with the winning Entry. You agree that the Sponsor may, at any time, edit, modify or remove the Entry, in whole or in part, and may disqualify an Entrant from the Contest if the Sponsor believes, in its sole discretion, that the Entrant has breached any of these Contest Rules.

5. PRIZE. (a) The prize is hereafter referred to as “Prize”. The Prize winner is hereafter referred to as the “Winner”. There is a total of one (1) Prize available to be won during the Contest Period. The Prize has an approximate retail value of $5300.00 CAD. Exact value of the Prize depends on point of departure as well as time of travel.

(b)The one (1) Prize consists of one (1) trip for two (2) people to Calgary, Alberta. This prize includes: 

  • One (1) round trip flight for two (2) people in Economy Class departing within Canada to Calgary International Airport (YYC).
  • Accommodations for three (3) nights*. Two (2) rooms based on single occupancy* for two (2) people with check-in on Tuesday, July 23, 2024 and check-out on Friday, July 26, 2024.
  • Round trip ground transportation from Calgary International Airport (YYC) to accommodations
  • Two (2) Grounds Passes to the CPKC Women’s Open on Wednesday, July 24, 2024
  • Two (2) Heritage Lounge Tickets to the CPKC Women’s Open on Thursday, July 25, 2024
  • Meet and Greet with Rose Zhang on Wednesday, July 24, 2024 at Earl Grey Golf Club
  • One (1) $500.00 pre-paid Visa gift card
  • One (1) Callaway Paradym Ai Smoke Driver, including a Custom Fitting at a Golf Town location (provided that the Winner can attend at a Golf Town store)

IMPORTANT NOTE: In the event that a confirmed Prize winner resides within a 300-kilometer radius of the CPKC Women’s Open (as determined by the Sponsor in its sole and absolute discretion), the Sponsor will determine, in its sole and absolute discretion, whether or not the Prize will include airline travel, another form of transportation to and from the CPKC Women’s Open, or reimbursement for certain incurred fuel costs. All decisions of the Sponsor in this regard will be final and binding without right of appeal. The Winner and his/her/their guest are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, supplementary ground transportation (including to and from the Winner’s departure airport, and travel between the hotel and the tournament venue), pre and post hotel accommodations, additional costs for vehicle rental (including gas and insurance), gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layovers, meals and beverages, service charges, baggage fees or medical travel insurance related expenses, obtaining and carrying all necessary travel documentation, and travel costs to a Golf Town location for the custom fitting portion of the Prize.

(c) Prize Redemption Restrictions and Conditions:

(i) The Winner and his/her/their travel guest must travel together both ways.

(ii) Travel must be booked through the Sponsor. The Sponsor shall not be liable for any expenses incurred by the Winner or his/her/their guest without Sponsor’s prior written approval.

(iii) The Winner must provide his/her/their and their guest’s travel details to the Sponsor no later than Tuesday July 9, 2024.

(iv) The Winner and his/her/their guest must abide by all venue policies and ticket terms and conditions. The Sponsor reserve(s) the right to revoke any full or partial Prize from the Winner or the Winner’s guest who it, or venue personnel, may deem, in its sole discretion, appear to be intoxicated, be a safety risk, have violated any venue policy or law, or may bring the Sponsor into disrepute.

(d) The Prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Sponsor. Any unused portion of a Prize will be forfeited and have no cash value. The Sponsor reserves the right, in its and its sole discretion, to substitute a prize of equal or greater value if a Prize (or any portion thereof) cannot be awarded for any reason.

(e) The Sponsor shall not assume any liability for lost, damaged or misdirected Prizes.

6. WINNER SELECTION. One (1) Winner will be selected on Tuesday July 2, 2024 at the Golf Town Store Support Centre located at 7777 Weston Road, Woodbridge, Ontario, one (1) entrant will be selected by a random electronic draw by a representative of the Sponsor following a review of eligible Entries received during the Contest Period.
The odds of being selected as a potential winner are dependent upon the number of eligible Entries received by the Sponsor. Before being declared a Winner, the selected entrant shall be required to: (i) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question, (ii) comply with the Contest Rules, and (iii) sign and return the Confirmation and Release (described below).

(b) The selected entrant will be notified by email and/or phone if provided no later than Tuesday July 2, 2024. The Sponsor will make a minimum of three (3) attempts to contact the selected entrant within four (4) business days of the draw date. Upon notification, the selected entrant must provide required information in compliance with these Contest Rules to the email provided in the notification, and the selected entrant’s response must be received within two (2) business days. If the selected entrant does not respond in accordance with the Contest Rules, he/she/they will be disqualified and will not receive the Prize and another entrant may be selected, in the Sponsor’s sole discretion, until such time as an entrant satisfies the terms set out herein. The Sponsor is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Sponsor to receive a selected entrant’s response. The Sponsor, in its sole discretion, reserves the right to abridge any of the timelines herein provided for any substitute entrant to respond.

(c) If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more selected entrants than contemplated in these Contest Rules, there will be a random draw amongst all remaining eligible Entries after the Contest’s closing date to award the correct number Prizes.

(d) ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE CONTEST SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. 

7. RELEASE. Each of the Winner and his/her/their guest will be required to execute a release and waiver (“Confirmation and Release”) that confirms such individual’s: (i) eligibility for the Contest, as applicable, and compliance with these Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of the Released Parties from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iv) grant to the Sponsor the unrestricted right, in the Sponsor’s individual discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the such individual’s name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof The executed Confirmation and Release must be returned within two (2) business days of the verification as a Winner or the selected Entrant will be disqualified and the Prize forfeited.

8. INDEMNIFICATION BY ENTRANT. By entering the Contest, Entrant releases and holds Released Parties harmless from any and all liability for any injuries, loss or damage of any kind to the Entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in the Contest, any breach of the Contest Rules, or in any Prize-related activity. The Entrant agrees to fully indemnify the Released Parties from any and all claims by third parties relating to the Contest, including without limitation any claims of infringement of rights to copyright, privacy and/or personality.

9. LIMITATION OF LIABILITY. The Sponsor assumes no responsibility or liability for: (a) lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete Entries, notifications, responses, replies or any Confirmation and Release, (b) any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry, (c) any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest, (d) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries, (e) any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing, (f) any injury or damage to Entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. The Sponsor assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsor, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest.

10. CONDUCT. By participating in the Contest, each Entrant agrees to be bound by the Contest Rules, which will be made available online at (www.golftown.com). Entrant further agrees to be bound by the decisions of the Sponsor, which shall be final and binding in all respects. The Sponsor reserves the right, in its sole discretion, to disqualify any Entrant found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any online Golf Town property or service; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Caution: Any attempt to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including but not limited to criminal prosecution.

12. INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

13. TERMINATION. The Sponsor reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest Rules in any way, at any time, for any reason without prior notice.

14. LAW. These are the official Contest Rules. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the Entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

15. LANGUAGE DISCREPANCY. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
